Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Zetwal AI (the “Service”), operated by Zetwal AI / CodeMiner (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you represent that you have obtained parental or guardian consent. By using the Service, you represent and warrant that you meet these requirements and have the legal capacity to enter into a binding agreement.

2. Account Registration

To access most features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and not share it with others.
  • Notify us immediately at support@zetwal.ai if you suspect unauthorized access to your account.
  • Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that we believe have been used fraudulently or in violation of these Terms.

3. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. You may not:

  • Copy, modify, or distribute any part of the Service without our prior written consent.
  • Reverse engineer, decompile, or disassemble any component of the Service.
  • Use the Service to develop a competing product or service.
  • Use automated tools (bots, scrapers, crawlers) to access the Service without permission.
  • Circumvent any access controls, rate limits, or security measures.

4. User Content

4.1 Your Content

You retain ownership of all audio recordings, projects, and other content you create or upload (“User Content”). By uploading User Content, you grant us a limited, worldwide, royalty-free license to store, process, and transmit your content solely for the purpose of providing the Service to you.

4.2 Prohibited Content

You agree not to upload or process content that:

  • Infringes any third party’s intellectual property rights, including copyrighted music, performances, or samples you do not own or have a license to use.
  • Contains malware, viruses, or malicious code.
  • Is defamatory, obscene, hateful, or otherwise unlawful.
  • Violates the privacy or publicity rights of any person.
  • You do not have the legal right to process through AI services.

4.3 Content Moderation

We do not actively monitor User Content but reserve the right to remove content that violates these Terms or applicable law.

5. AI Processing and Third-Party Services

Certain features of the Service use AI models provided by third parties, including ElevenLabs (for voice isolation and music generation) and Stripe (for payment processing). By using these features, you acknowledge that:

  • Your audio files will be transmitted to ElevenLabs for processing. ElevenLabs’ own terms and privacy policy apply to such processing.
  • AI-generated outputs may not always meet your expectations; we make no guarantee of specific results.
  • You are responsible for ensuring you have the rights to submit audio content for AI processing.

6. Subscriptions and Credits

6.1 Free Tier

The Service offers a free tier with limited features and credit allowances.

6.2 Paid Subscriptions

Premium subscription plans are billed on a recurring basis (monthly or annually) via Stripe. By subscribing, you authorize us to charge your payment method at the applicable rate. Subscriptions automatically renew unless cancelled before the renewal date.

6.3 Credit Packs

Credits may be purchased as one-time bundles. Credits are non-refundable once purchased and have an expiry date as stated at the time of purchase. Credits are consumed when you use AI enhancement features.

6.4 Refund Policy

Subscription payments are non-refundable except where required by applicable law. If you believe a charge was made in error, contact us within 14 days at support@zetwal.ai.

6.5 Price Changes

We reserve the right to change subscription prices with at least 30 days’ notice. Continued use of the Service after the notice period constitutes acceptance of the new pricing.

7. Intellectual Property

The Service, including its design, code, branding, and all original content created by us, is owned by Zetwal AI / CodeMiner and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you.

“ZETWAL AI” and associated logos are trademarks of CodeMiner. You may not use our trademarks without prior written permission.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZETWAL AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate the agreement formed by these Terms at any time. You may terminate by deleting your account (see our Account Deletion page). We may suspend or terminate your access immediately, without prior notice, if we determine you have violated these Terms or any applicable law. Upon termination, your license to use the Service ceases and we may delete your data in accordance with our Privacy Policy.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction, as required by applicable law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date and, where appropriate, by email notification. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
